THE THREE PENALTY BANDS UNDER ARTICLE 99

Prohibited practices under Article 5: up to 35 million euro or 7% of total worldwide annual turnover, whichever is higher. Social scoring, mass biometric surveillance, manipulative AI. Almost no SaaS lands here.

High-risk and Article 50 transparency violations: up to 15 million euro or 3% of turnover. This is the realistic band for most SaaS.

Incorrect or misleading information to authorities: up to 7.5 million euro or 1% of turnover.

HOW THE ESTIMATE WORKS

Enter your annual revenue and pick the violation tier. The tool returns the higher of the fixed ceiling and the percentage of revenue, the way a national authority would calculate it. For SMEs and startups, Article 99(6) applies the fine proportionally.
